Division of Assets & Debts
Other than custody of children, the most hotly contested issues in a divorce are usually dividing the assets and debts.
“Assets” include such things as real and personal property. “Real property” is land and the buildings on it. “Personal property” includes other items such as vehicles, furniture, jewelry, pets, etc. “Debts” are financial obligations such as mortgages, auto loans, credit cards, etc.
In Utah, the general rule is that all assets and debts accumulated during the marriage should be divided equitably. Sometimes, this means splitting everything down the middle. In other instances, a fair division of assets and debts may differ from dividing everything in half.
